Left-wing opposition Democratic Left Alliance (SLD) party notified prosecutors of alleged crime committed by the director of ¦w Rodziny municipal hospital in Warsaw prof. Bogdan Chazan by refusing a woman an abortion although a fetus had serious head and brain defects.

In Poland, abortion is legal until the 25th week of pregnancy when the mother's life is at risk or if the fetus is badly damaged or the result of rape or incest.

Chazan is one of some 3,000 Polish doctors who have signed a "Declaration of Faith" saying they are believers and consider abortion, birth control, in vitro fertilization and euthanasia as being against their faith.

According to Polish law, doctors may decline an abortion, owing to personal conscience, but they are obliged to refer patients elsewhere.

Doctors have to put their obligation to the patient and the law above their religious beliefs, Poland’s PM Donald Tusk said on Monday referring to the case of prof. Chazan. "Regardless of what his conscience is telling him, a doctor must carry out the law," Tusk said.

The patient has now lodged a complaint with the health ministry, which has ordered a review of the case.
