Supreme Court appeal to CJEU

The Court of Justice of the European Union (CJEU) will likely heed Poland's Supreme Court request for an accelerated preliminary ruling regarding the recent controversial reform, which forces some of the Supreme Court justices to retire before their terms end, dailies Dziennik Gazeta Prawna and Rzeczpospolita wrote.
The CJEU will prioritize the request and accelerate the analysis of the reform, various anonymous sources tell the dailies, which may lead to ruling being made within months.
Polish lawyers are unanimous in agreeing the Supreme Court had the right to send request for a preliminary ruling to the European Court of Justice, but that unanimity disappears when they are asked about the Supreme Court deciding on suspending select provisions of that reform, DGP noted. Some lawyers note that the suspension was used too broadly, others indicate that only such broad suspension may prevent irreversible legal changes from occurring.
